Terms Of Service

This is Loopzie’s Terms of Service Agreement that the client and artist agree upon for the commission of artwork. By commissioning the artist the client agrees to the following terms:


⭐1. GENERAL DISCLAIMERS⭐
I as the artist have the right to refuse or discontinue a commission at any point. Disrespectful behavior is not tolerated and can lead to the cancellation of a commission.
These terms may vary a little bit depending on the type of commission or be updated at any point.⭐2. PAYMENT AND FEES⭐- All payments are due 100% upfront done through Ko-Fi/Stripe using USD currency. Additional features will be an additional fee on top of the base price.
NDA: 50% - No WIPs or final artwork shared publicly unless otherwise stated.
Branding: 50% - Monetized content for businesses/content creators including but not limited to use on twitch/youtube/social medias.
Merchandising: 100% - For use of artwork including but not limited to digital/physical redistribution made with the commissioned artwork.⭐3. TIMELINE AND PROCESS⭐
Working days/hours are Monday-Friday 10:00am-5:00pm pst / 1:00pm-8:00pm EST.
After a commission is accepted and work begins, the status of it is regularly updated on my Trello page.
An initial sketch will be sent over for approval before continuing onto the coloring and rendering. All WIPs are sent with a watermark over them until the piece is fully finished.
Depending on the current queue, type of commission, and health of the artist; the typical turnaround is between 2-4 weeks.⭐4. REVISIONS⭐
During the sketching phase revisions can be asked for. Any major revision to the art piece after the linework is done will not be accepted. (e.g. pose change, outfit changes, etc.)
Revisions due to my own misunderstanding or missed features of the character are free of concern as I possibly missed something.
Please keep in mind larger revisions take time and the timeline for the commission may end up being longer than expected to account for the time it takes to make changes.
Please make sure the sketch is thoroughly checked and that you are satisfied with it before approving continuation!⭐5. RIGHTS & USAGE⭐
I as the artist retain rights to any commissioned works.
Any characters portrayed in the commission remain copyrighted to their rightful owners.
I reserve the rights to post the commission work on my social media, stream, record, and upload the creation of the artwork unless an NDA is additionally added to the commission.
The final products are strictly for personal use unless business or merchandising rights are additionally added to the commission.
Credit to the artist, me, is still required when using the artwork in any context including commercially.Artwork may NOT be used or edited in these ways:Claiming the artwork as your own creation.
Removal of my watermark/signature.
Paint over or alter the artwork.
Coloring in my sketches or lineart, or commissioning someone else to do.
Use my artwork in any technology related to AI (Artificial Intelligence), NFTs, and/or cryptocurrency. This will result in immediate blacklisting from any further commissions.
Reproduct my artwork commercially without purchasing the proper rights.⭐6. CANCELLATION & REFUNDS⭐
Once the final product is finished and approved by the client, a refund is no longer available.
The client may cancel the commission at any time, after which a refund of the equivalent work done will be returned. A full payment will not be available after work has started.
I as the artist reserve the right to cancel and refund the money for your commission at any time.
You may not file a chargeback against the artist after you have given approval of the artwork.⭐7. ACCEPTANCE⭐
Once the final artwork is approved and completed the client will receive their commission in a ZIP file through either email or Discord. Images are always sent as 300 DPI PNGs unless otherwise specified.Thank you for taking the time to read this and for considering commissioning me. By contacting the artist in regards to a commission, you, the client, are making an acknowledgement that you understand & agree to ALL of the above terms & that you're willing to accept full responsibility if said terms are violated.To reach out to the artist either see to the email tab on this website or message @loopzie on Discord.
